Abstract

In spite of the punctual reforms carried out in the Brazilian Penal Procedure Code regarding Preventive Prison, almost half of the individuals imprisoned in a closed regime in the prison system of Rio Grande do Sul have no final conviction. Thus, it seems essential to transpose the mere study of the Law in order to understand the real reasons for the high application of the precautionary measure in Rio Grande do Sul criminal proceedings, analyzing the speeches of power that permeate judicial decisions. The theoretical method for research was used. It was concluded that the language used by the legislator and the enforcer of the standard needs to be studied for a better understanding of the real meaning of precautionary incarceration in the context of the Brazilian legal system and what is behind its repeated application.
