JUDICIAL REVIEW IN THE LEGAL THOUGHT OF NEIL MACCORMICK

AN INSTITUTIONAL PROPOSAL FROM ARGUMENTATIVE THEORY

Abstract

This article seeks to outline a general model of judicial review based on Neil MacCormick's contributions to the legal reasoning theory and to the understanding of law as an institutional phenomenon. From an extensive reading of the Scottish jurist's work, it was aimed to identify how and to what extent his proposals for the rational controllability of judicial decisions and institutional morality can influence the achievement of greater solidity in the adjudicative exercise of constitutional courts. In the absence of a general theory of judicial review in MacCormick's theory, it was intended to draw a propositional construction of the central elements of an argumentative approach to judicial review, having as premises the concepts and conclusions of the legal philosopher about legal argumentation in the constitutional Rule of Law. As a conclusion, it was possible to verify in Maccormick's work the existence of conceptual and interpretative guides relevant to the oxygenation and ethical openness of constitutional decisions, which are aligned with a possible claim of objectivity, coherence, cohesion and universality in the assessment of constitutional validity of norms.
