On appeal by de public defender´'s office

This text analyses the guidelines established by de Public Defender of Rio Grande do Sul with regard to the obligation of the Public Defender to previously justify the Internal Affairs Department whenever he considers that the handling of the resource, in theory, is not adequate for the defense of the person's intesests assisted. The objectiv is to discuss to wether the prevailing understanding is compatible with the applicable legislation, as well as speculate on the consequences of the appeal policy that is build from these goals. The conclusion is that the revision of the consolidated guidance would be in accordance with the appropriate hermeneutics of the legal provisions studied, as well as could bring insitutional gains, either with those assisted, or in relation to other powers and institutions.
